Alstom Vietnam is looking for a Project Contract & Risk Manager based in Hanoi with substantial and broad expertise in a large and complex railway, construction and EPC consortium projects. You are expected to be equipped with technical expertise in contractual, financial, commercial understanding and leadership. You will work cross functionally and geographically with key stakeholders on project contract and risk management. You will report hierarchically to Head of Legal & Contract Manager China & East Asia and functionally to Consortium Project Director.
You will be responsible for:
• All contract management activities from contract award up to the final acceptance of the work and final account; and
• Identify any potential risks of the project that may impact the project or profitability of the company including to assess threats and put plans in place to avoid, reduce or transfer risks as appropriate.
• Prepare Contract Summary and ensure it is widely communicated and regularly updated.
• Define and implement a Consortium Project Contract & Risk Management Plans (part of the PMP)
• Ensure that all Consortium Project members (Coordination and Partners) are trained at an appropriate level in the discipline of Risk & Contract Management by running seminars and training courses.
• Propose risk owners within the Project for approval by the Project Director and Partners - Project Managers.
• Evaluate each identified risk in collaboration with the risk owners.
• Act as a support to risk owners for the definition, the implementation and the follow-up of mitigation actions.
• Ensure that the approved risk mitigation actions are integrated into the main Project schedule and budget, by linking with the project schedule and cost control team when and if applicable.
• Monitor progress on risks and risk mitigation actions.
• Create and maintain consolidated Risk Register.
• Produce regular Risk Assessment Reports.
• Ensure that elaboration of the CDRL by the Project team members is launched on time, and ensure it is accurately communicated and updated. Monitor Works towards contract obligations; check schedule and all milestones compliance. Monitor from Risk & Contract point of view the Engineering and Contractual Configuration activities.
• Establish and implement project specific commercial procedures, particularly regarding correspondences, notifications, insurances, variation requests / orders and claims preparation files. Ensure a reliable filing and easy access of the correspondence from, and to, the customer/partners
• Develop a pragmatic commercial approach based on contractual analysis of project, to protect on a daily basis AT interests towards customer, and, in liaison with Partners, sourcing, suppliers / subcontractors.
• Log and notice facts to customer, prepare and manage all elements and materials for negotiation of claims and counterclaims.
• Anticipate events and risks and propose various counter-strategies and commercial solutions to keep the situation under control.
• Monitor customer/partners requests to detect variation / change orders to be proposed.
• Management of customer/partners Variation Requests / Orders: follow up the VR / VO list, prepare commercial offer and prepare associated contractual letters for the Customer Director / Project Director approval.
• Manage correspondence by analysing for the Project Director all incoming correspondence, and preparing and reviewing all outgoing correspondence.
• Provide to the dedicated in-house lawyer of Legal and Contract Management, Customer Director (CD), Project Director (PD) and if any, Contract Management Director (CMD) a weekly (salient events) and monthly project contractual’ activity report and when relevant, alert or flash email.
• Inform the dedicated in-house lawyer of Legal & Contract Management, CMD about any amendment, variation, claim, and/or breach that could have significant impact on project in terms of cost and time.
• In liaison with Sourcing organisation ensure that terms and conditions are timely and wisely transferred to subcontractors and suppliers, and prepare the claim file with Quality and Sourcing whenever damages are impacting project performance.
• Manage sub-contracts and other similar agreements.
• Manage insurance matters in liaison with central insurance organisation within Contract Management Risk & Insurance.
• Provide at any time, on Management demand, a reliable and understandable contractual and commercial analysis of the project
• Manage, train and develop unit Contract project skills and knowledge particularly in order to transfer locally his duties and responsibilities after 2 years.
• Anticipate and manage risks and opportunities of the Project in an efficient and proactive manner.
• Ensure mitigation plans are defined and related actions are performed.
• Establish and quantify the project or Alstom’s 'risk appetite', i.e. the level of risk we are prepared to accept;

*Educational Requirements
Degree in Business Commercial / Engineering or similar including Contract Law higher level qualification.
You are expected to have technically:
• 10~15 years’ experience in Contract and Risk management domain in a sizeable multinational company
• Experience in Railway business or Industrial project is desirable
• Experience in Project Interface & Project Management for International large scale of projects
• Good knowledge of railway products and systems desirable
• Local customer experience desirable
