Mô tả công việc
1. Legal
• Sound knowledge and experience with the legal and regulatory framework under which CBRE Vietnam and its businesses are operating under;
• Advise on licensing issues, prepare and submit application dossiers for business licences required for CBRE Vietnam;
• Draft, negotiate, review, advise on commercial agreements with external parties, including suppliers and clients;
• Develop legal contract templates, standard documents applicable for business usage and regular review, update and enhancement of such documents;
• Advise on legal issues arising from employment matters and or employment related disputes;
• Assist in advising, co-ordinating and strategizing company’s legal position in cases of litigation and disputes involving CBRE Vietnam;
• Updating legal and/or regulatory requirements or changes;
• Assist in training for material and recurring legal issues applicable to the businesses in Vietnam.
2. Compliance
• Assist in establishing the regulatory compliance program, e.g. Anti-money Laundering, Personal Data Protection, Document Retention etc.;
• Assist in conducting monthly Anti-Corruption Monitoring Activities;
• Assist in verifying the proper completion of the FCPA Certification Quarterly;
• Assist in executing periodic compliance audit program;
• Assist in Compliance Review Board meetings with local management team in Vietnam;
• Assist in initiating and supporting policy developments and enhancement;
• Updating on regulatory requirements or changes and ensure compliance;
• Assist in preparing monthly Compliance Reporting;
• Promoting compliance culture and risk awareness across different levels of staff and promoting an open environment for raising concerns; and
• Driving best practices, operational excellence and process improvements.
3. Risk Identification, Monitoring and Evaluation
• Assist in providing strategic and tactical advice to business units on a broad range of risks that are or may affect the company, and monitor the process in managing risk mitigation plans; and
• Assist in driving the Annual Risk Assessment program and policies towards ensuring that risks and potential red flags are assessed and managed to an acceptable risk level.
4. Investigation
• Assist in managing internal investigations in accordance with the Company’s Investigations Policy; and
• Write investigation reports, provide guidance to stakeholders concerned in regard to the follow-up actions, and monitor the closure of follow-up actions.
5. Training and Education
• Assist in conducting new employee orientation training on the Company’s Standards of Business Conduct, Anti-Corruption and other compliance related topics;
• Assist in preparing relevant legal and compliance training materials as required;
• Assist in developing an annual compliance training calendar in line with Annual Compliance Risk Profile; and
• Assist and partner with local HR to ensure timely completion of the compliance trainings by all employees in Vietnam.

• Other projects and tasks as required from time to time.

Key Skills and Competencies
• Good written and verbal communication skills, both in English and Vietnamese;
• Strong interpersonal, negotiation, organizational and report writing skills;
• Attention to detail, diligent;
• Solutions oriented and proactive;
• Ability to multi-task, work independently and under pressure;
• Sense of commercial awareness;
• Understanding of local labour laws and experience in the real estate industry is preferred;
• Understanding of FCPA, Anti-corruption, Anti-Money Laundering, Know-Your-Customer Due Diligence is preferred;
• Experience in audit, investigation, training, policy development and process improvement is preferred.
Qualifications and experience
• Legal qualifications: Admitted to a Vietnamese bar association.
• Experience: 5 years practising experience in the legal and compliance sectors in a law firm or a multi-national company in Vietnam.
